IEP Reports was developed for Special Educators as an IEP Management Tool that includes Automatic Email Reminders to Teachers, an IEP Review System, Interactive Meeting Notes, and a Reporting Service that will help teachers and administrators stay on top of district deadlines. This system was designed for the use of Individual Users or entire Organizations.
Our Platform is available only to individuals who are at least 18 years old. You represent and warrant that if you are an individual, you are of legal age to form a binding contract, and that all information you submit is accurate and truthful. IEP Reports may, in its sole discretion, refuse to offer our Platform to any person or entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access our Platform is revoked in such jurisdictions.
You may browse our Platform and view its content without registering, but as a condition to using certain aspects of our Platform, you may be required to register with IEP Reports and select a password and screen name (or “User ID”). You shall provide IEP Reports with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms and Conditions of Use, which may result in immediate termination of your IEP Reports account. You shall not
RULES AND CONDUCT
(a) The term “Content” means any content generated, provided, or otherwise made accessible on or through our Platform, and may include any User submissions, information, data, text, photographs, scripts, interactive features, and other content. “Your Content” means Content generated, provided, or otherwise made accessible by you and/or through your account, including User submissions. “User Content” means Content generated, provided, or otherwise made accessible by other Users of our Platform. “IEP Reports Content” means Content generated, provided, or otherwise made accessible by IEP Reports or its suppliers.
(b) You are solely responsible for all of your activity in connection with our Platform and Your Content. IEP Reports is not responsible for Your Content. You shall not (and shall not permit any third party to) either (a) take any action or (b) upload, download, post, submit or otherwise distribute or facilitate distribution of any Content on or through our Platform, including any User submission, that:
i. Infringes any patent, trademark, trade secret, copyright, right of publicity or privacy, or other right of any other person or entity or violates any law or contractual duty
ii. You know is false, misleading, untruthful or inaccurate
iii. Is harmful to minors in any way.
iv Constitutes unsolicited or unauthorized advertising or promotional material or any junk mail, spam or chain letters
vi. Contains software viruses or any other computer codes, files, or programs that are designed or intended to disrupt, damage, limit or interfere with the proper function of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any system, data, password or other information of IEP Reports or any third party
vii. Impersonates any person or entity, including any employee or representative of IEP Reports
(c) Additionally, you shall not:
i. Take any action that imposes or may impose (as determined by IEP Reports in its sole discretion) an unreasonable or disproportionately large load on IEP Reportss infrastructure (or its third-party providers infrastructure)
ii. Interfere or attempt to interfere with the proper working of our Platform or any activities conducted on our Platform
iii. Bypass any measures IEP Reports may use to prevent or restrict access to our Platform (or other accounts, computer systems or networks connected to our Platform)
iv. Run Mail list, Listserv, any form of auto-responder or “spam” on our Platform
v. Use manual or automated software, devices, or other processes to “crawl” or “spider” any page of our Platform
(d) You shall not (directly or indirectly):
i. Decipher, decompile, disassemble, reverse engineer or otherwise attempt to derive any source code or underlying ideas or algorithms of any part of our Platform, except to the limited extent applicable laws specifically prohibit such restriction
ii. Modify, translate, or otherwise create derivative works of any part of our Platform,
iii. Copy, rent, lease, distribute, or otherwise transfer any of the rights that you receive hereunder. You shall abide by all applicable local, state, national and international laws and regulations
(e) IEP Reports does not guarantee that any Content will be made available on our Platform. IEP Reports has no obligation to monitor our Platform or Content. However, IEP Reports reserves the right, to remove, edit or modify any Content, to suspend or terminate your account, or to take other actions (e.g., reporting you to law enforcement), in its sole discretion at any time, with or without notice to you and for any reason (including upon receipt of claims or allegations from third parties or authorities relating to such Content or if IEP Reports is concerned that you may have violated the Terms and Conditions of Use), or for no reason at all
(f) IEP Reports is not obligated to backup any Content and Content may be deleted at any time. You are solely responsible for creating backup copies of Your Content if you so desire
(g) IEP Reports is not responsible for User Content. IEP Reports cannot guarantee the identity of any other Users with whom you may interact in the course of using our Platform. IEP Reports does not endorse and has no control over User Content. IEP Reports cannot guarantee the authenticity of any data which Users may provide about themselves. You acknowledge that all Content accessed by you using our Platform is at your own risk and you will be solely responsible for any damage or loss to any party resulting therefrom
CONTENT AND LICENSE
You agree that the services include content specifically provided by IEP Reports or its partners and that such content is protected by copyrights, trademarks, service marks, patents, trade secrets or other proprietary rights and laws. You shall abide by and maintain all copyright notices, information, and restrictions contained in any content accessed through the services.
IEP Reports grants each User of our Platform a worldwide, non-exclusive, non-sub licensable and non-transferable license to use, modify and reproduce the Content, solely for personal, non-commercial use. Use, reproduction, modification, distribution or storage of any Content for other than personal, non-commercial use is expressly prohibited without prior written permission from IEP Reports, or from the copyright holder identified in such Contents copyright notice. You shall not sell, license, rent, or otherwise use or exploit any Content for commercial use or in any way that violates any third party right.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by IEP Reports at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
While we try to offer reliable data, we cannot promise that the catalogs will always be accurate and up-to-date, and you agree that you will not hold our catalog providers or us responsible for inaccuracies in the catalogs. These catalogs may include copyrighted, trademarked or other proprietary materials. You agree not to remove any copyright, proprietary or identification markings included within the catalogs or create any derivative works based on catalogs content (other than by including them in your listings).
While access and use of our Platform is free for all Users, IEP Reports charges a flat annual service fee for different packages. IEP Reports may change its fees from time to time by posting the changes on our Platform 15 days in advance, but with no advance notice required for temporary promotions. BILLING AND PAYMENT POLICY
IEP Reports reserves the right, at any time, to modify its fees and billing methods and correct any payment errors even if it has already requested and/or received payment. IEP Reports may use third party payment processing services to process payments. While IEP Reports will use commercially reasonable efforts to protect the privacy of all personal and financial information, IEP Reports expressly disclaims any and all liability whatsoever for any controversies, claims, suits, injuries and/or damages, arising from and/or in any way related to IEP Reportss use of third party payment processing services, including without limitation for any damage that may result should any such information be released to any third parties. PERSONAL INFORMATION WE COLLECT FROM YOU
You provide us information about yourself, such as your name, age, address, email address, and password, when you register for a Member account with the Service. If you correspond with us by email, we may retain the content of your email messages, your email address and our responses. We may also retain any messages you send through the Service. You may provide us information in User Content you post to the Service. IEP Reports does not collect or save any information from children 13 years of age and younger.
IEP Reports collects your personal payment information, including information stored on outside services that you may use with IEP Reports, such as PayPal. By submitting your payment information and/or linking your IEP Reports account with an outside payment service such as PayPal, you authorize IEP Reports to access and use this information in order to provide you with and accept payment for the Service. This allows us to both confirm your identity and provide you with seamless, hassle-free transactions
IEP Reports sends a "cookie" to your computer or smart phone that contains an identification number that is unique to the device you are using. We use this cookie to provide you with a seamless experience, and so that we can record how our service is being used. A cookie does not collect personal information about you, but may convey anonymous information about how you browse the Service to us. A persistent cookie remains on your hard drive after you close your browser. Persistent cookies may be used by your browser on subsequent visits to the site. Persistent cookies can be removed by following your web browser's directions. A session cookie is temporary and disappears after you close your browser. IP Address and Logins:
We log each visit to each web page on the Service.
